AGREEMENT TO TERMS
These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Archival Arms LLC, in regards to the usage, access, and any business or purchases made with Archival Arms LLC and the respective website. This agreement extends to any external media channels, email communications, phone communications, etc.. All services and media sources offered and controlled by Archival Arms LLCs will hereby referred to as “Archival Arms”
Review our separate Privacy Policy for more information on how we store, use, share, and protect your data. This website is not intended for use outside the United States of America, where laws may conflict with its Privacy Policy.
You agree that by accessing Archival Arms, you have read, understood, and agree to be bound by all of these Terms of Use. If you do not agree with all of these Terms of Use, the you are not legally able to utilize Archival Arms and should exit immediately
Any updates to the Terms and Conditions of Archival Arms will be listed as updates here and contain the appropriate date on which the revision or addition was made.
It is the duty and responsibility of the user/client, to periodically review these terms and conditions in order to understand what they are and how they impact the client.
Archival Arms make all reasonable attempts to comply with international law, due to the nature of items sold here certain iconography, and ideologies may be represented as a byproduct of the sell, curation, and documentation of historical militaria and firearms. These icons and ideological beliefs reflected by said items do not represent the beliefs of Archival Arms.
INTELLECTUAL PROPERTY RIGHTS
Unless noted otherwise all content of Archival Arms is considered proprietary property, this includes all images, logos, listings, and documentation efforts. We expressly forbid the copying of any content for commercial or profit based purposes without explicit written permission before hand. We do however encourage users to feel free to utilize our content in any efforts to maintain historical documentation of equipment, markings, and any efforts in the preservation or discussion of history in the event it is not for profit.
USER REGISTRATION
In the event that a user chooses to register with the website we require that the Username be appropriate, and that the user has registered solely with intention of legally acceptable commerce or communications. It is the responsibility of the user to comply with all local laws and regulations, state or regional laws and regulations, and national laws and regulations.
CONTRIBUTION LICENSE
As a user in the event you contribute to any portion of the website either via the comment function, review function, or via direct communication with the site owner you are authorizing Archival Arms to utilize your contribution without any restrictions in the event we deem it valuable or beneficial to the function of Archival Arms, the documentation or authentication of historical artifact, or the sell of an item.
GUIDELINES FOR REVIEWS AND CONTRIBUTIONS
Certain functions and sections of Archival Arms may allow you to leave public reviews and comments. We require the following
(1) If leaving a review for services provided by Archival Arms you must have had first hand experience or direct contact with Archival Arms;
(2) Your reviews should not contain offensive profanity, or abusive, racist, offensive, or hate language;
(3) Your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability;
(4) Your reviews should not contain references to illegal activity;
(5) You should not be affiliated with competitors if posting negative reviews;
(6) You should not make any conclusions as to the legality of conduct;
(7) You may not post any false or misleading statements;
(8) You may not organize a campaign encouraging others to post reviews, whether positive or negative.
We may accept, reject, or remove reviews at our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us and do not necessarily represent our opinions or the views of any of our affiliates or partners.
We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free, fully-paid, assignable, and sublicensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/or distribute all content relating to reviews.
THIRD-PARTY WEBSITES AND CONTENT
Archival Arms may utilize third party links, content, websites, and resources. Archival Arms is not responsible for the actions, or content, of any of these third party websites.
TERMINATION OF ACCOUNT
Archival Arms reserves the right to terminate a user’s account in the event that the user’s actions have been determined to be in violation of the aforementioned Terms and Conditions. If the user’s account is terminated they are expressly forbidden from the creation of a new account on Archival Arms even if requested by a 3rd party.
GOVERNING LAW
All content created, posted, or maintained by Archival Arms LLC is made in accordance with U.S. National Law and the State of Ohio’s laws.
DISPUTE RESOLUTION
Informal Negotiations
In order to expedite any conflict resolution the user of Archival Arms is required to accept informal negotiations as the first step to any conflict resolution. In the event informal negotiations do not yield results the User is required to pursue binding arbitration as a solution to any issue.
Binding Arbitration
In the event binding arbitration is required this will be the final step to acceptable conflict resolution. As a result of binding arbitration the user may be prevented from any legal recourse including civil settlements unless required by the arbitrator.
The arbitration shall be commenced and conducted under the Commercial Arbitration Rules of the American Arbitration Association (“AAA”) and, where appropriate, the AAA’s Supplementary Procedures for Consumer Related Disputes (“AAA Consumer Rules”), both of which are available at the AAA website www.adr.org.
Your arbitration fees and your share of arbitrator compensation shall be governed by the AAA Consumer Rules and, where appropriate, limited by the AAA Consumer Rules.
The arbitration may be conducted in person, through the submission of documents, by phone, or online. The arbitrator will make a decision in writing, but need not provide a statement of reasons unless requested by either Party.
The arbitrator must follow applicable law, and any award may be challenged if the arbitrator fails to do so. Except where otherwise required by the applicable AAA rules or applicable law, the arbitration will take place in the appropriate venue closest to the location where the dispute occurred.
Except as otherwise provided herein, the Parties may litigate in court to compel arbitration, stay proceedings pending arbitration, or to confirm, modify, vacate, or enter judgment on the award entered by the arbitrator.
No conflict resolution, arbitration, or civil settlements may be pursued more than 1 year after the business transaction with Archival Arms by the user. Archival arms holds no liability for the usage of any items sold and they are sold in AS IS condition. The user accepts the inherent risk of the items, firearms, or militaria purchased from Archival Arms and is solely responsible for their safe usage and any injuries or damages caused by the usage of said items. Archival Arms makes best efforts to ensure that items are provided in a functional manner unless otherwise noted, but cannot be held responsible in the event of any failure or damage caused by said items.
CORRECTIONS
Archival Arms reserves the right to make changes on the website at any given time to, add, remove, correct, or elaborate on information previously provided. Archival Arms has no legal requirement or expectation to maintain information, posts, or content, and does so by its own choice.
DISCLAIMER
Archival Arms is presented as is. Archival Arms holds no liability for the accuracy of the information or content on Archival Arms. Archival Arms LLC and its owner(s) hold no liability for the usage of any items purchased from Archival Arms. Archival Arms reasonably expects users to comply with all laws and regulations governing the purchase, usage, and storage of firearms including NFA items such as automatic weapon and destructive devices. Archival Arms cannot be held responsible for any of the damages, injuries, or loss of firearms or militaria as a result of usage. This includes a formal limitation of liability waiving all owners, employees, or investors from liability for the usage of these items by the purchaser or user. The staff and owners of Archival Arms cannot be held legally responsible for damages, loss of revenue, punitive damages, loss of data or other damages from the use of any items purchased from Archival Arms or the usage of Archival Arms
